Ember Marketing Plan
1. Scope of Work
Sizzle agrees to provide the following services under the Ember Essentials Marketing Plan for the Client:
Package Deliverables:
- Brand positioning and messaging review
- 6-month marketing strategy outline
- 3-month content calendar
- Basic SEO audit with recommendations
- Social media growth strategies
- 60-day actionable marketing plan
2. Payment Terms
The total fee for the Ember Essentials Marketing Plan is $3,500, due in full upon signing this Agreement.
- 100% Payment Upfront: The Client agrees to pay the total fee of $3,500 upfront to initiate services. Services will not commence until the payment has been processed.
3. Timeline
The Ember Essentials Plan will be delivered within 2-4 weeks from the start date, depending on the Client’s availability for approvals and feedback. The timeline will be agreed upon after the upfront payment is received.
4. Revisions and Feedback
- The Client is entitled to 2 rounds of revisions per deliverable (branding, strategy, content calendar).
- Feedback must be provided within 5 business days after receiving each deliverable to ensure timely project progression.
Any additional revisions or delays beyond the agreed timeframe will be billed at $95/hour.
5. Stall/Cancel Fee Policy
- If the Client fails to provide feedback, assets, or approvals within 10 business days, a Stall Fee of $50/week will be applied to the project to cover administrative costs and delayed progress.
- If the project remains inactive for 30 days without Client communication, Sizzle reserves the right to terminate the Agreement and retain all payments made to date as a Cancellation Fee.
- If the Client wishes to restart the project after termination, a new Agreement and payment structure will be required.
6. Client Responsibilities
- Provide access to any necessary assets (logos, brand guidelines, etc.) required to execute the marketing plan.
- Respond to all requests for feedback, approvals, and questions within 5 business days to maintain the project timeline.
7. Intellectual Property Rights
Upon full payment, the Client will own the rights to all final deliverables provided under this agreement. Sizzle retains the right to use select elements of the project for promotional purposes, including portfolio showcases and marketing materials, unless otherwise agreed in writing.
8. Use of Work & Client Headshot for Promotional Purposes
The Client agrees that Sizzle may use the completed work, including client headshots or brand assets, for promotional purposes, such as portfolio showcases, social media, or case studies, unless the Client notifies Sizzle in writing.
9. Confidentiality
Both parties agree to keep all sensitive project information confidential. Neither party shall disclose any proprietary or confidential information without prior written consent, except as necessary to perform the services under this Agreement.
10. Termination and Refunds
- The Client may cancel this Agreement with 14 days’ written notice.
- If the Agreement is canceled after the work has begun, no refund will be issued for work completed up to the cancellation date.
Sizzle reserves the right to terminate this Agreement if the Client fails to comply with the terms outlined herein.
11. Governing Law
This Agreement shall be governed and interpreted in accordance with the laws of the state of Missouri, United States.
12. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between them.
